Terms of Service, Campsite & Daytrip Guest Policies
Please read this document carefully before making a booking. By completing a booking or checking in, the lead guest confirms that all participants have read, understood and agreed to these policies.

Definitions
Definitions
“Booking Fee” means the total amount paid for the reservation of the package selected by the guest, excluding the refundable security deposit and any later incidental charges.
“Lead Guest” means the person named as the main guest in the booking. The Lead Guest must be at least 18 years old, must stay at the resort, and is responsible for the conduct and charges of all occupants and approved visitors.
“Guest” includes the Lead Guest, all registered occupants or participants, children, and any visitor approved by management.
“Daytrip” refers to a non-staying guest, whether camping or staying in a chalet.
For pax capacity purposes, a βChildβ means a person between 3 and 12 years old. Guests aged 13 and above are counted as adults. Infants below 3 years old are not counted in the pax number.
“Maximum pax” refers to the number of participants or guests permitted in a specific lot or package.
“Lot” refers to the type of camping ground in the campsite.
“Package” refers to the product offered or sold by management in terms of service, accommodation and related activities provided within it.
“Management” means Pasakon Beach Resort, its authorized managers, employees and representatives.
All stated times refer to local time in Malaysia. Cancellation deadlines are calculated from the scheduled check-in time of 1:00 PM.

1. Booking, Payment & Confirmation Policy
Guests must read and understand these policies before making any reservation.
Bookings and payments must be made through the resort's official website or another channel expressly authorized by management.
A booking is confirmed only after full payment has been successfully received and a booking ID has been issued.
The Lead Guest must provide accurate personal, contact and number of participants information. Management must be informed promptly if any information changes.
Guest must ensure to comply with the minimum or maximum pax specified in the offered package before making payment.
Guests are also advised to verify that the offered package suits their needs and matches their requirements or interest before making a booking payment.
The booking confirmation, booking ID and payment record should be retained and presented when requested.
Bookings may not be transferred, resold or assigned to another person without prior written approval from management.
Special requests, including early check-in, accessibility assistance, adjoining rooms/campground, specific chalet/campground locations or any amendments in the package offered are subject to availability and are not guaranteed unless confirmed in writing.
Guests should disclose any mobility, medical or accessibility requirement before booking so that management can explain whether the available facilities or package offered are suitable. Management cannot guarantee facilities or assistance that were not confirmed in writing.
2. Cancellation, Amendment, Refund & No-Show Policy
Cancellation and amendment requests must be submitted through the official booking or contact channel and are effective only after management acknowledges them.
Promotional, discounted or package bookings are non-refundable unless the written offer states otherwise or a refund is required by applicable law.
A request to change the booking date must be made at least 72 hours before the original check-in time.
A date change is subject to availability. If the new date has a higher rate, the guest must pay the difference before the change is confirmed.
A guest who changes the booking date and later cancels will receive no more than 50% of the Booking Fee, even when the later cancellation is made more than 72 hours before the new check-in date.
A booking is treated as a no-show when the guest does not arrive by 7:00 PM and has not obtained written approval for late arrival, or does not arrive by an agreed late-arrival time.
If a guest voluntarily checks out early, unused package is non-refundable unless management agrees otherwise in writing or a refund is required by applicable law.
Approved booking refunds will be initiated within 7 business days through the original payment method where possible. Bank or payment-provider processing times may take longer.
3. Check-In, Registration & Late Arrival
Daytrip hour starts at 9:00 AM and ends at 6:00 PM.
Camper check-in begins at 1:00 PM. Early check-in is subject to availability and prior written approval.
All guests must be registered at reception before entering.
The Lead Guest must present the booking ID and a valid identity card or passport at registration.
A refundable security deposit of RM50 for each individual package booked is required at check-in. The deposit may be withheld or deducted for policy breaches, damage, loss or other chargeable matters.
If the required security deposit is not paid, check-in will not proceed and the Booking Fee will not be refunded.
Reception closes at 6:00 PM. Guests expecting to arrive later must provide an estimated arrival time and receive confirmation from management before reception closes.
Guests may not change confirmed check-in or check-out arrangements without management approval.
Management may refuse check-in or end a package paid without refund where a guest provides false information, refuses to register, exceeds capacity, fails to pay required charges, seriously breaches these policies, or poses a safety, security or nuisance risk.
Participants are requested to adhere to the scheduled times to ensure that the offered activities can proceed as planned. A suggested timeframe will be provided for reference in each individual package promoted.
In the event of delay caused by the visitor that prevents an activity from taking place due to reasons such as safety concerns, limitation of time, weather changes, tide changes or any reasonable matter, the activity will not be rescheduled and the booking fee will not be refunded.
4. Camping Lot Occupancy Limit Policy
Maximum pax permitted in a specific lot are solely based on the policy stated in the table above.
Campers must obey the pax limit listed by the management.
Additional pax will be charged based on the standard rate per pax stated by the management.
Maximum and minimum pax includes adults and children unless management confirms otherwise in writing.
Infants (below 3 years old) are not counted in the pax number.
Only registered pax may stay in the provided camping lot. Management may refuse entry or involvement to unregistered persons or excess pax.
Concealing additional participants or allowing unauthorized visitors may result in additional charges, immediate forfeiture of the security deposit, termination of the package and removal of excess participants.
Maximum pax permitted for daytrip guests are solely based on the policy stated in the table below.
Guest must pay for additional camping lot if their number of pax exceed the maximum occupancy.
5. Campsite Rules & Safety Regulations Policy
Registration and Allocation
All campers or daytrip guests must register upon arrival before occupying the campsite. Campers must set up tents only within the designated campsite area assigned by the management or booked by the campers. Tent must not obstruct roads, walkways, emergency access routes, drains or other resort facilities.
Check-In and Check-Out
All campers or daytrip guests must follow check-in and check-out policy regulated by the management. Camping site must be vacated by the required check-out time and all personal belongings and camping equipment must be removed.
Campsite Occupancy Limit
Each camping lot has a maximum occupancy limit. Guests must not exceed the approved number of pax without prior approval from the management. Please refer to the "Camping Lot Occupancy Limit Policy" above.
Cleanliness and Waste Disposal
Guests are responsible for maintaining the cleanliness of their camping lot. All rubbish must be placed in the designated bins. Littering or dumping waste into drains, the beach or the sea is strictly prohibited. If found guilty, a fine will be imposed via the security deposit.
Noise Control
Campers or daytrip guests must respect the comfort and privacy of other guests. Excessive noise, loud music, karaoke, or other activities that disturb other guests are prohibited within quiet hours. Quiet hours are between 10:00 PM and 7:00 AM. Pasakon management reserves the right to stop any disturbance during these hours.
Electrical Safety
Guests must not tamper with, modify, or interfere with the Resort's electrical installations. Unsafe electrical equipment, damaged cables, overloaded sockets, or connections that may create a fire hazard are prohibited. The usage of high-voltage electrical appliances such as rice cookers is strictly prohibited - please seek advice from management. The usage of any electrical source or sockets is strictly prohibited during bad weather such as heavy rain and thunderstorms.
Campfire and BBQ
Campfires and BBQ activities are permitted only in designated areas approved by campsite management. Open fires, charcoal, or BBQ equipment must not be placed inside tents, chalets, under trees, near dry vegetation, or in any area that may create a fire hazard. Guests must maintain a safe distance between fire or BBQ equipment and tents, vehicles, buildings, trees, vegetation and other combustible materials. Campfires and BBQ equipment must be supervised by a responsible adult at all times while in use. All campfires and BBQ fires must be completely extinguished before leaving the campsite, going to sleep or ending the BBQ activity. Fireworks, unauthorized open fires, and burning rubbish, leaves, plastic, waste or other combustible materials are strictly prohibited.
Weather and Environmental Conditions
Guests must remain alert to changing weather and environmental conditions, particularly strong winds, heavy rain, lightning, high tides, strong currents and other potential hazards. Pasakon management reserves the right to temporarily close or restrict access to the campsite when conditions are considered unsafe.
Personal Belongings
Guests are responsible for securing their own tents, camping equipment, vehicles and personal belongings. The resort shall not be responsible for loss, theft or damage to personal property except where liability cannot be excluded under applicable law.
Smoking
Smoking is prohibited inside tents and in any designated non-smoking areas. Cigarette butts must be completely extinguished and disposed of safely in the designated bins provided by the management.
Drugs and Alcohol
Any use of drugs is strictly prohibited. Alcoholic beverages are still permitted, however any disorder or disturbance arising from consumption will be stopped immediately.
Right to Suspend or Terminate Camping
Management reserves the right to suspend camping activities or require a guest to leave the campsite where necessary to protect the safety, security or comfort of guests, staff or resort property. Illegal drugs, dangerous weapons, gambling, violence, harassment, disorderly conduct, excessive intoxication and any illegal activity are strictly prohibited.
6. Damage, Loss & Compensation Policy
Guests must take reasonable care of the accommodation provided in the package and its contents, water sport activity equipment, and all resort property.
A participant staying in a chalet or campsite will be regulated through the chalet or campsite policy accordingly.
Guests are responsible for damage, loss or destruction caused intentionally, negligently, accidentally through misuse or recklessly, or by any occupant or approved visitor connected with their booking.
Normal wear and tear will not be charged. Cleaning, repair, restoration, replacement, labour, transport and reasonable administrative costs caused by a guest may be charged.
If total charges exceed the security deposit, the Lead Guest must pay the remaining balance upon request. Management will provide a reasonable explanation or itemized list of deductions.
7. Fire Safety & Emergency Policy
Guests should identify the nearest safe exit, fire extinguisher, alarm point and designated assembly area upon arrival.
Guests must keep roads, walkways, emergency access routes, fire equipment and evacuation areas clear at all times. Vehicles, tents, tables, chairs or other personal belongings must not obstruct emergency access.
Fire alarms, extinguishers, emergency lights and other safety equipment must not be covered, moved, damaged or tampered with.
If a fire, serious injury, drowning risk or other life-threatening emergency occurs: stay calm and move away from immediate danger; call Malaysia Emergency Response Services at 999; notify management as soon as it is safe to do so; use the nearest safe exit and proceed to the designated assembly area; do not use unsafe routes, return for belongings or re-enter until authorized by management or emergency personnel; assist children and vulnerable persons only when it is safe and do not place yourself in further danger.
A guest who intentionally or negligently causes a fire, tampers with safety equipment or disregards emergency instructions is responsible for resulting losses and may be removed without refund.
Management may report an incident to the authorities, seek compensation and take legal action where appropriate.
Pasakon Beach management reserves the right to evacuate, temporarily close, or restrict access to the campsite where necessary due to fire, severe weather, hazardous conditions or any other emergency situation.
8. Water, Electricity & Service Disruption Policy
Electricity, water, internet, mobile coverage and other services may be interrupted by utility-provider failures, maintenance, severe weather or circumstances beyond the resort's reasonable control.
The resort does not currently operate a standby generator. A power interruption may also affect the water supply because the pump system relies on electricity.
Management will take reasonable steps to restore normal operations and provide updates when reliable information is available.
Except where required by law or expressly stated below, the resort is not responsible for inconvenience, loss or disruption caused by circumstances beyond its reasonable control.
If both electricity and water remain continuously unavailable for more than 4 consecutive hours, the guest will receive a refund equal to 20% of the total Booking Fee.
The 20% refund is the stated compensation for that interruption unless management agrees otherwise or additional compensation is required by law.
Guests may shorten their stay or check out early during a prolonged interruption, but any additional refund remains subject to this policy, management approval and applicable law.
9. Beach, Weather & Outdoor Safety Policy
A beach environment involves natural risks, including changing tides, waves, slippery surfaces, deep water, sharp objects, insects, animals, falling branches and sudden weather changes.
Guests must obey safety signs, barriers, warnings and instructions issued by management or public authorities.
Guests must not enter the sea or restricted outdoor areas during thunderstorms, strong winds, rough conditions, flooding, poor visibility, at night, or whenever management advises that conditions are unsafe.
Swimming, beach use and outdoor activities are undertaken at the guest's own risk. Guests must assess their ability, health and the conditions before participating.
Children and vulnerable persons must be supervised by a responsible adult at all times, especially near the beach, water, roads, steps and balconies.
Management may temporarily close the beach access, outdoor facilities or any unsafe area without prior notice when necessary for safety, weather, maintenance or official instructions.
Guests must not feed, touch, capture or disturb wildlife and must not remove coral, shells, plants or other protected or natural items where removal is prohibited.
10. Children, Vulnerable Guests & Medical Needs Policy
Parents and legal guardians are fully responsible for the supervision, behavior and safety of children and vulnerable persons in their care.
Children must not be left alone without adult supervision in a chalet, vehicle, near the beach or in any area where there is a foreseeable safety risk.
Resort staff do not provide childcare, lifeguard supervision, nursing care or medical treatment unless expressly stated in writing.
Guests should bring all necessary medication, mobility equipment and personal medical supplies.
In an emergency, management will make reasonable efforts to contact emergency services and assist. Medical, transport, evacuation and related expenses remain the guest's responsibility unless the law provides otherwise.
11. Parking & Vehicle Policy
Vehicles must be parked only in designated areas and must not block entrances, roads, emergency access routes or other vehicles.
Guests must drive slowly and carefully through the resort and the surrounding residential area and must follow signs and management instructions.
Vehicles and their contents are parked at the owner's risk. Guests should lock their vehicles and avoid leaving valuables visible.
The resort is not responsible for theft, loss or damage to a vehicle except to the extent that liability cannot lawfully be excluded.
Unauthorized vehicle repairs, fuel storage, dangerous driving and vehicle access into chalet or guest-only pedestrian areas are prohibited.
12. Lost & Found Policy
Guests should check their belongings carefully before departure.
Found items should be reported to management. Guests claiming an item may be asked to provide identification and a clear description.
Non-perishable items will normally be kept for up to 30 days after check-out. After that period, unclaimed items may be disposed of, donated or handled as management considers appropriate.
Perishable, unhygienic, hazardous, illegal or low-value items may be disposed of immediately.
Collection or delivery of a found item is at the owner's cost and risk. The resort is not responsible for loss or damage occurring during third-party delivery.
13. Privacy, Personal Data, CCTV & Photography Policy
The resort may collect and process personal information needed for reservations, identity verification, payment, communication, guest service, safety, security, legal compliance and handling complaints or incidents.
Personal data will be handled in accordance with the resort's privacy notice and applicable Malaysian personal data protection requirements.
Information may be shared with payment providers, booking-system providers, professional advisers, emergency services or public authorities where reasonably necessary, authorised or required by law.
Where CCTV is installed, clear notices will be displayed. CCTV footage is used primarily for safety, security, incident investigation and protection of property.
A guest's photograph or video will not be used for advertising or promotional publication solely because the guest checked in. Separate consent should be obtained where a person is clearly identifiable, and a guest may decline promotional photography.
Guests should not submit another person's personal information unless they are authorised to do so and have informed that person how the information will be used.
14. Check-Out Policy
Check-out time is 12:00 PM. Guests must vacate the camping ground before the required time.
Delay in check-out time will be compensated via the deposit payment under the regulated rate determined by the management.
A delay that affects the next booking may result in additional reasonable charges.
Guests are advised to inform the management if they want to extend the check-out time or need extra time to vacate the camping site, subject to availability and applicable charges.
15. Security Deposit Refund Policy
The security deposit is refundable after check-out and completion of the inspection where necessary for chalet or campsite guests and equipment used.
Management may temporarily withhold the deposit until the inspection is completed.
If a deduction is made, the guest will be informed of the reason and amount. Any remaining balance will be refunded.
Guests are encouraged to remain near reception until the inspection is completed so that an eligible cash refund can be made immediately.
A cash deposit may be collected at reception after inspection. An eligible refund by online transfer will be processed within 24 hours.
Where charges exceed the deposit, the outstanding amount remains payable by the Lead Guest.
A guest who disputes a deduction should contact management promptly and provide relevant evidence. A dispute does not remove the obligation to pay an amount that is reasonably supported.
16. Force Majeure, Operational Changes & Policy Administration
Events beyond the resort's reasonable control may include severe weather, flood, fire, epidemic, government direction, road closure, civil disturbance, public-utility failure, natural disaster or another event that prevents or materially affects normal operations.
During such an event, management may close facilities, restrict access, relocate guests, change operating hours, suspend services or cancel a booking when reasonably necessary for safety or operations.
Where the resort is unable to provide the booked package, management may offer a comparable or better alternative, a date change, credit or refund, depending on the circumstances, availability and applicable law.
During an activity, if the provided activity is unable to be carried out due to severe weather or bad sea water conditions that could threaten participants' safety, Pasakon management reserves the right to stop or not carry out further beach activity.
Management may update these policies. The version accepted at booking will normally apply, but immediate safety, legal or operational changes may take effect during a stay when reasonably necessary.
If any clause is found invalid or unenforceable, the remaining clauses continue to apply.
These policies are governed by the laws of Malaysia. Nothing in this document removes a consumer or guest right that cannot legally be excluded.
Management will exercise its rights and discretion reasonably, consistently and without unlawful discrimination.
17. Liability, Responsibility & Guest Acknowledgement
Guests are responsible for their own safety, personal decisions and compliance with safety instructions, warning signs and these policies.
Guests are responsible for safeguarding cash, documents, devices, jewellery and other personal belongings. The resort is not responsible for loss, theft or damage except to the extent that liability cannot lawfully be excluded.
Guests accept the ordinary and inherent risks of staying near a beach and participating in recreational, outdoor and water sport activities, including slips, falls, drowning risk, weather, insects, animals and natural hazards.
To the fullest extent permitted by law, the resort is not liable for indirect or consequential loss, loss caused by a guest's negligence or policy breach, acts of unrelated third parties, or events beyond the resort's reasonable control.
Nothing in these policies excludes or limits liability that cannot legally be excluded or limited.
The Lead Guest is responsible for ensuring that all occupants and approved visitors understand and comply with these policies.
By completing a booking, registering or occupying a chalet, each guest confirms that these policies have been read, understood and accepted.
