Terms of Service, Group Package, Event & Programme Policies
Please read this document carefully before making a booking. By completing a booking or checking in, the lead guest confirms that all participants have read, understood and agreed to these policies. The lead guest is responsible for sharing the policies with every person included in the booking.

1. Purpose
a) This policy establishes the terms and conditions governing the booking, payment, cancellation, postponement and general management of programmes conducted at Pasakon Beach.
b) This policy applies to group programmes, corporate events, family days, team building programmes, training programmes, schools and educational programmes, government and NGO programmes, camping programmes, catering programmes and other organised events.
c) Specific activities or facilities may be subject to additional terms under the relevant Pasakon policies.
2. Scope of Application
a) This policy applies to all programme organisers, companies, organisations, schools, government agencies, NGOs, event organisers, group leaders and participants engaging Pasakon for an organised programme.
b) Where a programme includes accommodation, camping, water sports, recreational activities or other specialised facilities, the relevant Pasakon policy shall also apply.
c) In the event of any conflict between this policy and a specific activity or facility policy, the specific policy shall apply to that particular activity or facility.
3. Quotation & Programme Proposal
a) All programme bookings shall be based on an official quotation or written programme proposal issued by Pasakon.
b) Quotation requests may be made through the Pasakon Beach website.
c) The quotation may include, where applicable: venue or programme space, accommodation, campsite facilities, meals and catering, activities and recreational facilities, equipment and facilities, tables, chairs and event setup, audio-visual or PA equipment, staff and operational support, and other services specifically agreed upon.
d) The quotation is prepared based on the information provided by the organiser, including programme date, duration, estimated number of participants and selected services.
e) Any services or equipment not stated in the quotation shall not be considered included unless subsequently confirmed in writing or by any other means by Pasakon.
4. Booking Confirmation & Payment Methods
a) A programme booking shall only be considered confirmed after the quotation has been accepted by the organiser and the required confirmation deposit has been received by Pasakon.
b) A quotation or tentative booking does not automatically guarantee availability of the venue, facilities or programme date.
c) Pasakon reserves the right to release an unconfirmed date to another customer if the required confirmation deposit is not received within the agreed period.
d) The organiser shall provide accurate programme information, including the expected number of participants, programme schedule, meal requirements and activities required.
e) A 30% confirmation deposit based on the approved total quotation value is required to secure and confirm the programme booking, unless otherwise agreed in writing.
f) The 30% confirmation deposit shall be paid within 14 days of accepting the quotation and no later than fourteen (14) days before the programme date, unless otherwise agreed in writing.
g) The confirmation deposit shall be treated as payment towards the total programme charges.
h) The booking date shall only be officially secured upon receipt of the required confirmation deposit.
i) Pasakon may apply different requirements for special, high-value, customised or short-notice programmes where necessary.
j) Where the confirmation deposit is not applicable for certain payment methods, the three payment routes and their requirements to secure a booking are shown in the Payment Routes table above.
k) For programmes paid under LPO or PO, the organiser is required to provide the official LPO, PO, Letter of Award or official Work Order 21 days before the commencement of the work or services.
l) For programmes arranged through e-procurement or an electronic procurement system, the organiser shall ensure that Pasakon is officially invited to participate in the procurement process within the agreed timeframe before the programme date.
m) The organiser must initiate the procurement invitation 21 days before the programme date, unless otherwise agreed.
5. Payment Terms
a) Unless otherwise agreed in writing, the standard payment arrangement is a 30% deposit at booking confirmation and the remaining 70% balance, as shown in the Payment Schedule table above.
b) The remaining balance shall be settled no later than the programme date, unless a different payment schedule has been agreed in writing.
c) Where payment is required before the programme, the organiser shall ensure that payment is received within the stated payment deadline.
d) Pasakon reserves the right to suspend or withhold programme services where the required payment has not been received.
e) All payments shall be made through the payment method or bank account officially provided by Pasakon.
f) Payments through LPO or e-procurement are required to follow all the credit terms stated by Pasakon.
6. Final Number of Participants
a) The organiser shall provide Pasakon with the final expected number of participants for quotation preparation.
b) The final number of participants may be used to determine catering quantities, accommodation requirements, seating arrangements, activity capacity, equipment requirements, staffing requirements or final programme charges.
c) Any increase in participant numbers after the confirmation deposit may result in additional charges.
d) Additional participants shall only be accepted where venue capacity, safety requirements, facilities and available resources permit.
e) A reduction in participant numbers after the deposit confirmation may not automatically result in a reduction of the agreed programme charges, particularly where food, staffing, equipment or other services have already been prepared or committed.
7. Programme Changes & Additional Services
a) Any request to change the programme schedule, menu, facilities, activities, accommodation, equipment or other services shall be subject to availability and approval by Pasakon.
b) Additional services requested after the quotation or deposit confirmation has been accepted may incur additional charges.
c) Any additional charges shall be communicated to the organiser before the additional service is provided where reasonably practicable.
d) Pasakon is not responsible for providing services or facilities that were not included in the confirmed quotation.
8. Programme Booking, Cancellation, Postponement & Rescheduling Terms
a) A confirmation deposit is required to secure the programme booking. The deposit must be paid within 14 days from the date of the official quotation or no later than 14 days before the programme date, whichever comes earlier.
b) The programme shall only be considered confirmed upon receipt of the required confirmation deposit.
c) Once the confirmation deposit has been received, cancellation of the confirmed booking is not permitted, and the deposit is non-refundable.
d) Postponement: where the organiser is unable to proceed with the original programme date, the confirmation deposit may be transferred as a booking credit towards a new programme date.
e) Rescheduling is subject to availability of the new requested date, operational capacity, existing bookings, seasonal considerations, supplier and staffing arrangements.
f) The booking credit shall be valid for 3 months from the original programme date. Any applicable difference in charges arising from the new date or revised programme arrangements shall be borne by the organiser.
g) Any unused booking credit after the 3-month validity period shall automatically be forfeited and shall not be refundable.
h) If the confirmation deposit has not been received within 14 days from the date of the official quotation, the booking shall remain unconfirmed, the organiser may cancel the programme without cancellation charges, and Pasakon reserves the right to release the proposed programme date.
9. Late Payment or Non-Payment
a) Failure to make payment within the agreed period may result in suspension of services, cancellation of unconfirmed arrangements, withdrawal of facilities or activities, and additional or operational charges where applicable.
b) Pasakon reserves the right to refuse continuation of programme services where outstanding payment materially affects the agreed booking arrangements.
10. Programme Cancellation or Interruption by Pasakon
a) Pasakon reserves the right to cancel, postpone, suspend or modify a programme where circumstances beyond its reasonable control affect the safety, operation or availability of the programme.
b) Such circumstances may include severe weather, flooding, dangerous sea water conditions, natural disasters, fire, power or water supply disruption, government directives or restrictions, public emergencies, major facility or infrastructure failure and any other circumstances beyond the reasonable control of Pasakon.
c) Where reasonably possible, Pasakon shall communicate any major changes to the organiser as soon as practicable.
d) Where a programme is cancelled or postponed due to circumstances beyond the control of Pasakon, the parties may agree on an alternative programme date or other appropriate arrangement.
11. Catering & Meal Arrangements
a) Catering arrangements shall be based on the menu, number of participants and meal schedule stated in the confirmed quotation.
b) Changes to the menu, meal timing or number of participants must be communicated to Pasakon as early as possible, subject to availability and operational limitations.
c) Additional meals or participants or special dietary requirements should be communicated during the booking process.
d) The standard serving times applied by Pasakon are shown in the Meal Serving Times table above. Any alteration requested by the organiser should be informed in writing 3 days before the programme starts. On-the-spot serving time alterations during the programme are subject to operational capacity, existing bookings, supplier and staffing arrangements.
e) Additional serving times or meals are subject to additional cost, operational capacity and staffing arrangements.
12. Programme Schedule
a) The organiser shall provide Pasakon with the confirmed programme schedule where required.
b) The organiser is responsible for ensuring that participants arrive at the designated venue at the agreed time.
c) Delays caused by the organiser or participants may affect the programme schedule and availability of facilities. Programme activities may not automatically be extended due to late arrival.
d) Any extension beyond the agreed programme period shall be subject to availability and may incur additional charges.
13. Participants Safety & Responsibilities
a) The organiser is responsible for ensuring that all participants comply with Pasakon's rules, safety instructions and facility requirements.
b) Participants must follow instructions given by Pasakon staff, activity personnel and appointed programme coordinators.
c) Participants shall use facilities and equipment responsibly and only for their intended purposes.
d) Pasakon may restrict or suspend participation in an activity where a participant's conduct creates a safety risk to themselves, other participants, staff or property.
e) Specific safety requirements for accommodation, camping, water sports and other activities shall be governed by the respective Pasakon policies.
14. Children & Minors
a) Children and minors participating in a programme must remain under appropriate supervision by their parent, guardian, teacher, organiser or designated responsible adult.
b) The organiser is responsible for ensuring that minors comply with applicable activity and safety requirements.
c) Certain activities may have age, height, weight or other participation restrictions.
15. Damage, Loss & Misuse of Property
a) The organiser and participants are responsible for taking reasonable care of Pasakon property, facilities and equipment.
b) The organiser may be held responsible for damage caused by participants where such damage results from misuse, negligence or intentional acts.
c) Charges for repair, replacement or restoration may be imposed where applicable.
d) Personal belongings brought onto the premises remain the responsibility of the owner.
e) Pasakon shall not be responsible for loss or damage to personal belongings except where required by applicable law.
16. Unauthorised Activities, Alcohol & Prohibited Items
a) The organiser and participants shall comply with all applicable Malaysian laws and Pasakon's house rules.
b) Illegal activities, dangerous conduct, unauthorised use of facilities and activities that may endanger other guests or staff are prohibited.
c) Pasakon reserves the right to stop or restrict any activity that is considered unsafe, unauthorised or in breach of the agreed programme terms.
17. Cleanliness & Environmental Responsibility
a) The organiser and participants are expected to maintain cleanliness throughout the programme. Waste shall be disposed of at designated locations.
b) Disposing of any waste or food waste into drains or outside the designated locations will be fined accordingly.
c) Participants shall not damage vegetation, marine life, beach areas or other natural surroundings.
d) Additional cleaning or restoration charges may apply where excessive waste, damage or unusual cleaning requirements result from a programme.
18. Force Majeure
a) Pasakon shall not be considered liable for failure or delay in providing services caused by circumstances beyond its reasonable control.
b) Such circumstances may include natural disasters, severe weather, fire, flood, government action, public emergencies, major infrastructure failure, utility disruption, or other unforeseen circumstances beyond reasonable control.
c) Pasakon shall make reasonable efforts to minimise disruption and communicate significant changes to the organiser.
19. Management's Right to Modify Programme Arrangements
a) Pasakon reserves the right to make reasonable changes to programme arrangements where necessary for safety, operational requirements, weather conditions, facility availability or circumstances beyond its control.
b) Where possible, Pasakon will provide an alternative arrangement of a reasonably comparable nature.
c) Any major change affecting the agreed programme shall be communicated to the organiser where reasonably practicable.
20. Compliance with Other Pasakon Policies
a) Where applicable, the following policies form part of the programme terms: the Pasakon Chalet Policy, the Pasakon Campsite Policy and the Pasakon Water & Beach Sport Policy.
21. Acceptance of Terms
a) Acceptance of the quotation and payment of the required confirmation deposit shall constitute acknowledgement and acceptance of the applicable Pasakon programme terms and conditions.
b) The organiser confirms that the information provided to Pasakon is accurate and complete to the best of their knowledge.
c) The organiser is responsible for communicating relevant programme rules, safety requirements and responsibilities to all participants.
d) By proceeding with the booking, the organiser acknowledges that the programme will be conducted in accordance with Pasakon's applicable policies and operational requirements.
22. Policy Review
a) Pasakon reserves the right to review and update this policy from time to time to reflect operational requirements, safety considerations, legal requirements and improvements to its services.
b) The latest version of the policy shall apply to future bookings unless otherwise agreed in writing.
